Tesla just got called out by the NHTSA for making false claims about the Model S' safety. The Model S received 5 stars from the NHTSA and Tesla added the extra .4 based on their own calculations of how likely an occupant is to be injured in a crash.
The NHTSA's Press Release:
"The National Highway Traffic Safety Administration is committed to improving safety on the nation's roadways and helping motorists make informed decisions about new or used vehicles they are considering purchasing. The agency's 5-Star Safety Ratings program is designed to provide consumers with information about the crash protection and rollover safety of new vehicles beyond what is required by Federal standards. One star is the lowest rating; five stars is the highest. More stars equal safer cars. NHTSA does not rate vehicles beyond 5 stars and does not rank or order vehicles within the star rating categories. In addition, the agency has guidelines in place for manufacturers and advertising agencies to follow to ensure that accurate and consistent information is conveyed to the public."

This doesn't seem like a rebuke, but more like a "Hey, we don't wanna piss off "real" car manufacturers. You know, the ones with dealerships. "

They made false claims about the safety of the Model S and claimed the NHTSA gave the car 5.4 stars. That's false advertising and misrepresentation. The last sentence of the release reads like a warning to me. That and the fact that the NHTSA issued a press release rather than ordering Tesla to issue the statement qualifies this as a rebuke in my book.

C'mon Tesla. Your product is excellent. No need to resort to the creepy, overprotective, rig-the-already-massively-rigged-in-our-favor-scales bullshit that Ferrari pulls. There's just no need for it. You don't need to invent imaginary numbers to tell us how safe your car is. The picture speaks for itself. Just look at it - 0% deformation of the safety cage. I bet the door still opens and closes as normal.
Don't turn into Ferrari. Just don't. Don't fucking do it. Don't let me read about how you won't let Jalopnik test your new Model Z ten years from now because of some bad stuff they helped someone else say about you that one time. Don't do it. Just don't.

Did you read the Jalopnik article about Nightline earlier today? It sounds like Tesla is already there.
